VISION INSIGHTS PRIVACY POLICY

Introduction

Vision Sports Properties, LLC, doing business as Vision Insights, and its affiliates (“Vision Insights” or “Company” or “we” or “our“) respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the website www.visioninsights.net and all related sites, mobile apps, software, podcasts, newsletters, and services (the “Vision Platform“) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • By your access or use of the Vision Platform;
  • Via our forms, applications, or other digital products you use;
  • From your interactions with our products and services, whether electronically or in-person;
  • In email, text, and other electronic messages between you and the Vision Platform; and;
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by any third party including (i) information collected on websites designed by the Company for the use of a third party and (ii) where information may be collected by parties outside of the control of the Company, such as survey providers we partner with to collect your information. In such case, you understand and acknowledge that by providing your information you are consenting to the privacy policy of the applicable third party.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Vision Platform and not to utilize any of the services we provide on our platforms. By accessing or using the Vision Platform or our services, you acknowledge that you have read, understood, and agree to this Privacy Policy. This policy may change from time to time (see “Changes to Our Privacy Policy” below). Your continued use of the Vision Platform after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 13

The Vision Platform is not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on the Vision Platform. We do not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent. If you are under 13, do not use or provide any information on the Vision Platform or provide any information about yourself to us through the other methods described above, including your name, address, telephone number, email address, or any screen name or user name you may use. If you are a parent or guardian and believe that your child under 13 has provided us with personal information without your consent, please contact us immediately at legalnotice@visioninsights.net so that we can take appropriate action. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. In compliance with the U.S. Children’s Online Privacy Protection Act (COPPA), we will also notify parents or guardians as required. Information We Collect About You and How We Collect It

We collect several types of information from and about users of the Vision Platform, including:

  • Personal Information: By which you may be personally identified, such as your name, postal address, email address, telephone number, date of birth, age, gender, race/ethnicity, job title and role, industry, employer information, and any other identifier by which you may be contacted online or offline (“Personal Information”);
  • Non-Identifiable Information: That is about you but does not individually identify you, such as general demographic data or feedback provided through surveys;
  • Technical Information: About your internet connection, device type, operating system, browser type, IP address, and other information related to the equipment you use to access the Vision Platform or participate in Vision Insights events;
  • Behavioral Information: Collected automatically, including usage details, browsing history, page interactions, and information collected through cookies, web beacons, or other tracking technologies;
  • Publicly Available Information: From publicly accessible sources or as part of a lawful integration with your use of the Vision Platform; and
  • Third-Party Information: Received from business partners or sponsors associated with the Vision Platform.

Information You Provide to Us

The information we collect on or through the Vision Platform may include:

  • Information Provided During Registration: Information that you provide by filling in forms on the Vision Platform, including but not limited to, forms related to registrations, subscriptions services, and requests for additional service;
  • Correspondence Records: Records and copies of your communications with us, including email addresses, phone numbers, or other contact information, when you reach out for inquiries or support;
  • Survey Responses: Your responses to surveys that we may ask you to complete for research or service improvement purposes;
  • Event-Specific Information:  Details of transactions, registrations, or subscriptions that you provide as part of participating in Vision Insights events;
  • Payment or Financial Information: Details of transactions carried out through the Vision Platform, including financial information required to complete purchases, such as credit card numbers or billing addresses, if applicable;
  • Search Queries and Usage Data: Details of searches or interactions you perform on the Vision Platform; and
  • User Contributions: Information you provide to be published or displayed (hereinafter, “posted”) on public areas of the Vision Platform, or transmitted to other users or third parties (collectively, “User Contributions“).

Your User Contributions are posted at your own risk. While we provide settings to limit access to certain information, no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Vision Platform with whom you may choose to share your User Contributions. As such, we cannot and do not guarantee that your User Contributions will not be viewed or used by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with the Vision Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the Vision Platform, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Vision Platform; and
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically may include Personal Information or we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve the Vision Platform and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns;
  • Store information about your preferences, allowing us to customize the Vision Platform according to your individual interests;
  • Speed up your searches; and
  • Recognize you when you return to the Vision Platform.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies).A cookie is a small file placed on the hard drive of your computer. Cookies allow us to identify your preferences, remember session details, and enhance your browsing experience. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Vision Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to the Vision Platform; and
  • Web Beacons.Pages of the Vision Platform and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) These allow us to track user interactions, count visitors to specific pages, determine the effectiveness of campaigns, and monitor system performance and server integrity.

We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or you provide to us.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Vision Platform are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Information:

  • To operate, maintain, and improve the Vision Platform;
  • To provide you with the products, services, or information you request from us;
  • To communicate with you about your account, transactions, newsletter, the Vision Platform, and other relevant activities;
  • To deliver tailored content, offers, and targeted advertising, and to measure their effectiveness;
  • To administer prize draws and competitions when you elect to participate in competitions;
  • To process transactions, administer competitions, and provide customer support;
  • To conduct research and analysis to improve and develop our products and services;
  • To fulfill contractual obligations and enforce our rights, including billing and collection;
  • To comply with legal obligations, ensure data security, and protect the integrity of our systems; and
  • For any other purpose disclosed when you provide the information or with your consent.

We may also use your information to contact you about our own or third-party goods and services that may be of interest to you. If you do not want us to use your information in this way, you can opt out by contacting us directly. Disclosure of Your Information

We may disclose aggregated information about our users and information that does not identify any individual without restriction, including for analytics, reporting, or service improvement purposes.

We may disclose Personal Information that we collect or you provide as described in this privacy policy:

  • To our affiliates;
  • To contractors, service providers, and other third parties we use to support our business;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by the Company about the Vision Platform users is among the assets transferred;
  • To third parties, including sponsors, institutional partners, or advertisers, to market their products or services to you if you have consented to such disclosures or have not opted out. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. For more information, see the section titled “Choices About How We Use and Disclose Your Information” below;
  • To fulfill the purpose for which you provide it;
  • When using third party software integrated into the Vision Platform, such as Avalara, Google Analytics, Klaviyo, Stripe, and WMT;
  • For any other purpose disclosed by us when you provide the information; and
  • With your consent.

We may also disclose your Personal Information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly; and
  • Promotional Offers from the Company. If you do not wish to have your email address, contact information, or gameplay preferences used by the Company to promote our own or third parties’ products or services, you can opt-out by adjusting your preferences in your account settings, checking the opt-out box on registration or data collection forms, or contacting us directly at legalnotice@visioninsights.net. If we have sent you a promotional email, you can opt-out by clicking the “unsubscribe” link in the email or replying with a request to be omitted from future communications. Please note that this opt-out does not apply to information provided as part of Vision Insights tournament participation, product purchases, or other transactional communications.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI“) on the NAI’s website here.

Residents of certain jurisdictions, such as Delaware, the European Union, and the United Kingdom, may have additional personal information rights and choices. Please see “Your Jurisdictional Privacy Rights” below for more information.

Accessing and Correcting Your Information

You can review and change your Personal Information by sending us an email at legalnotice@visioninsights.net to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Residents of certain jurisdictions, such as Delaware, the European Union, and the United Kingdom, may have additional personal information rights and choices. Please see “Your Jurisdictional Privacy Rights” below for more information.

Your Jurisdictional Privacy Rights

United States

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.

Delaware provides (now or in the future) their state residents with rights to:

  • Confirm whether we process their Personal Information;
  • Access and delete certain Personal Information;
  • Correct inaccuracies in their Personal Information, taking into account the information’s nature processing purpose;
  • Data portability;
  • Opt-out of personal data processing for:
    • targeted advertising;
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects; and
  • Either limit (opt-out of) or require consent to process sensitive personal data.

European Union and United Kingdom

Under European Union and United Kingdom privacy laws, residents have the right to:

  • Be given clear, transparent information about who is processing their data, what is being processed, and why;
  • Request confirmation as to whether their personal data is being processed, and if so, access to that data plus additional information about how it is used and shared;
  • Correct inaccuracies or incomplete information in the personal data a controller holds;
  • Request erasure (the “right to be forgotten”) of their personal data in certain circumstances;
  • Request that an organization limit how their personal data is used in specific scenarios;
  • Request data portability, enabling them to obtain and reuse their personal data for their own purposes across different services;
  • Restrict or object to the processing of their personal data under specific conditions;
  • Not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects or similarly significant impacts, except under specific exemptions outlined by law;
  • Lodge a complaint with the Information Commissioner’s Office (for United Kingdom residents only) or supervisory authority in the Member State (for European Union residents only) of your habitual residence, place of work, or the place of the alleged infringement (for European Union residents only), if you believe request is denied or not handled satisfactorily.

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Please do not provide unsolicited Personal Information in any field on the Vision Platform, in email communications to the Company, or via other methods. We assume no risk or liability for protecting unsolicited information.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to the Vision Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Vision Platform.

Data Retention Criteria

We retain Personal Information only for as long as is necessary to fulfill the purposes for which it was collected, including meeting any legal, regulatory, tax, accounting, or reporting requirements, or establishing or defending legal claims. In determining the appropriate retention period for different categories of data, we consider the nature and sensitivity of the Personal Information and our legal and regulatory obligations. Once the relevant purpose no longer applies or where we are not otherwise required by law to retain the information, we will either delete, anonymize, or securely store your Personal Information until deletion is possible. Changes to Our Privacy Policy

We will update this Privacy Policy as required by law or as our data practices evolve. When changes are made, we will post the updated policy on this page and revise the “Last Updated” date at the top of the policy. If changes materially affect how we collect, use, or disclose your Personal Information, we will provide a notice on the Vision Platform home page, as required by applicable law. We encourage you to periodically review this page to stay informed about any updates to our privacy practices.
